Talq Ibn \u02bfAli (Allah be pleased with him) narrated that a man said to the Prophet (salall\u0101hu\u02bfalaihi wasallam):<\/p>\n

\u201cI touched my penis \u2014 does a man who touches his penis during the prayer have to refresh his wudoo\u2019?\u201d<\/strong> So the Prophet (salall\u0101hu \u02bfalaihi wasallam) replied:<\/p>\n \u0644\u064e\u0627, \u0625\u0650\u0646\u064e\u0651\u0645\u064e\u0627 \u0647\u064f\u0648\u064e \u0628\u064e\u0636\u0652\u0639\u064e\u0629\u064c \u0645\u0650\u0646\u0652\u0643\u064e<\/p>\n \u201cNo \u2014 it is just a member of your body.\u201d<\/strong><\/p>\n [Saheeh: reported by Ahmad (3\/22-23), Abu Dawood (182), An-Nas\u0101\u2019ee (1\/101), At-Tirmidhi (85), Ibn M\u0101jah (483), Ibn Hibb\u0101n (2\/223) \u2014 graded saheeh by al-Alb\u0101ni in al-Mishk\u0101t (1\/104), and he said in his notes on Subulus-Sal\u0101m: \u201cWhoever declared it to be weak as no proof.\u201d Ibn Hajr said in al-Fath (1\/254), \u201cSaheeh or hasan.\u201d]<\/p>\n Busrah bint Safw\u0101n (Allah be pleased with her) narrated that the Prophet (salall\u0101hu \u02bfalaihi wasallam) said: <\/p>\n \u0645\u064e\u0646\u0652 \u0645\u064e\u0633\u064e\u0651 \u0630\u064e\u0643\u064e\u0631\u064e\u0647\u064f \u0641\u064e\u0644\u0652\u064a\u064e\u062a\u064e\u0648\u064e\u0636\u064e\u0651\u0623\u0652<\/p>\n \u201cWhoever touches his penis should perform wudoo\u2019.\u201d<\/strong><\/p>\n [Saheeh: Ahmad (6\/406), Abu Dawood (181), an-Nas\u0101\u2019ee (1\/100), at-Tirmidhi (82), Ibn M\u0101jah (479), Ibn Hibb\u0101n \u2014 graded saheeh by al-Alb\u0101ni in al-Irw\u0101\u2019 (1\/150)]<\/p>\n The scholars, from the time of the Sah\u0101bah till now, have held various views regarding this issue. <\/p>\n First:<\/strong> A group stated that it nullifies the wudoo\u2019. <\/p>\n Second:<\/strong> Another body of scholars held that it does not nullify the wudoo\u2019. <\/p>\n Third:<\/strong> Yet another group of scholars held that it is recommended and not obligatory to make wudoo\u2019 after touching the private parts, and this was the view of Im\u0101m Ahmad and Ibn Khuzaymah. It was also the preferred opinion of Ibn Taymiyyah and Ibn \u02bfUthaimeen. By doing so, they gathered between the two hadeeth, and acted upon both. <\/p>\n Fourth:<\/strong> There is another view that states that the wudoo\u2019 is nullified when the private part is touched with desire. This has been reported as one of the sayings of Ahmad, Malik and the preferred view of al-Alb\u0101ni in \u2018Tam\u0101m al-Minnah.\u2019 <\/p>\n It is known in the arena of Usool al-Fiqh that harmonising and gathering between the saheeh narrations is a branch of authenticating them [because by harmonising, they are all acted upon]. So, harmonising is given precedence over singling one to be followed to the exclusion of another \u2014 and it is given precedence over claiming abrogation without clear proof. Since both of the hadeeth are authentic, then to act upon them both leaves us with the third and fourth above views of the scholars. <\/p>\n And it is the third saying among the sayings of the scholars that is better, and Allah knows best.<\/strong> The fourth view is not as strong since there is no clear evidence in the ah\u0101deeth that includes the mention of touching with desire. <\/p>\n So, in conclusion, it is desirable and recommended, not obligatory, for a man or woman to make wudoo\u2019 after touching their private parts \u2014 or even each other\u2019s private parts.<\/p>\n As for the hadeeth ascribed to Abu Hurayrah where the Prophet (salall\u0101hu \u02bfalaihi wasallam) said:<\/p>\n \u00ab\u0625\u0650\u0630\u064e\u0627 \u0623\u064e\u0641\u0652\u0636\u064e\u0649 \u0623\u064e\u062d\u064e\u062f\u064f\u0643\u064f\u0645\u0652 \u0628\u0650\u064a\u064e\u062f\u0650\u0647\u0650 \u0625\u0650\u0644\u064e\u0649 \u0630\u064e\u0643\u064e\u0631\u0650\u0647\u0650 \u0644\u064e\u064a\u0652\u0633\u064e \u0628\u064e\u064a\u0652\u0646\u064e\u0647\u064f \u0648\u064e\u0628\u064e\u064a\u0652\u0646\u064e\u0647\u064e\u0627 \u0634\u064e\u064a\u0652\u0621\u064c \u0641\u064e\u0644\u0652\u064a\u064e\u062a\u064e\u0648\u064e\u0636\u064e\u0651\u0623\u0652<\/p>\n \u201cWhen one of you touches his private part with his hand, and there is no barrier (cloth) between his hand and his penis, then let him make wudoo\u2019.\u201d<\/strong> Reported by ash-Shafi\u02bfee and ad-D\u0101ruqutnee. The narration is weak, not authentic, as stated by Shaikh al-Alb\u0101ni. See his notes on Mishk\u0101t al-Mas\u0101beeh 1\/105.<\/p>\n Shaikh al-Alb\u0101ni was asked about touching the private parts while making ghusl, and whether it nullifies the wudoo\u2019. So he responded that in that situation, the wudoo\u2019 is not invalidated.
